HR-10041-119
Referred to the Committee on Transportation and Infrastructure, and in addition to the Committees on Armed Services, and Energy and Commerce, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.
Sponsored by Eugene Vindman (D-VA)
What it does
This bill would direct the Secretary of Commerce to conduct a study on the effects of locating data centers within or near military installations, rail hubs, airports, air cargo facilities, air traffic control facilities, and industrial zones. The study would assess construction costs, impacts on energy grids, water systems, and the environment, identify suitable locations with adequate infrastructure capacity, and identify potential federal incentives to encourage data center siting at these locations. The Secretary would be required to submit a report of findings to four congressional committees within 180 days of enactment.
Who benefits
Data center developers and operators who may gain access to federal incentives or clearer siting guidance. Technology companies that rely on data center infrastructure. Communities near military bases or industrial zones that could see economic development and job creation. The federal government and military, which could benefit from co-located data infrastructure. Rail and airport authorities that may attract new tenants. Energy and utility companies that could gain new large-scale customers. Policymakers who would receive structured information to guide future legislation.
Who is hurt
Existing businesses and residents near covered locations who may face increased competition for energy, water, and land resources if the study leads to future incentive programs. Local governments that currently zone and control land use near these facilities, whose authority could be preempted by future federal incentive structures. Environmental groups concerned about data centers' significant water and energy consumption. Competing data center markets in locations not covered by the study, which could be disadvantaged if federal incentives are later directed toward covered locations.
Supporters argue
Supporters argue that data centers are critical national infrastructure and that co-locating them near military bases, airports, and industrial zones could leverage existing power and water infrastructure while reducing sprawl into undeveloped areas. They contend that a rigorous federal study is a prudent, low-cost first step — gathering evidence before committing to any spending or regulatory program — and that identifying federal incentives could accelerate private investment in strategically important locations without mandating any particular outcome.
Opponents argue
Opponents argue that this bill duplicates work already being done by the private sector and existing federal agencies, and that directing the Secretary of Commerce to study federal incentives presupposes a policy conclusion before the evidence is gathered. They contend that co-locating large data centers near military installations or air traffic control facilities could introduce security, electromagnetic interference, or operational risks that a Commerce Department study — rather than a defense or aviation authority — may be poorly positioned to fully evaluate.
Constitutional context
No significant constitutional issue is raised by this bill. Congress has broad authority under the Commerce Clause (Art. I, §8, cl. 3) to direct executive agencies to conduct studies and report findings. Directing the Secretary of Commerce to study data center siting is a routine exercise of that authority and does not implicate active constitutional disputes.
Checks and balances
The executive branch (Secretary of Commerce) gains a directed study mandate, but Congress retains oversight through the required report to four committees; no new regulatory or spending authority is granted by this bill.
Historical precedent
Congress has previously directed agency studies on infrastructure siting and energy use, including provisions in the Energy Policy Act of 2005 and the CHIPS and Science Act of 2022, which examined technology infrastructure needs and federal incentive structures.
