HR-10070-119
Referred to the House Committee on Oversight and Government Reform.
Sponsored by Andy Barr (R-KY)
What it does
This bill would amend title 5 of the United States Code to remove a grade-level restriction on overtime pay for Border Patrol agents. Currently, a specific overtime pay provision under section 5550(h) applies only to agents at the GS-12 pay grade. This bill would strike that grade limitation, making the overtime pay provision available to Border Patrol agents at all GS pay grades.
Who benefits
Border Patrol agents below the GS-12 pay grade (primarily GS-7 through GS-11 entry- and mid-level agents) who would become newly eligible for the expanded overtime pay. Agents at border stations with high operational tempo who regularly work beyond standard hours. Indirectly, border communities and the agency itself if the pay increase aids in recruitment and retention of lower-grade agents.
Who is hurt
Federal taxpayers who would bear the cost of expanded overtime pay obligations. The federal budget broadly, as increased mandatory compensation costs could affect discretionary spending elsewhere. Private-sector security and law enforcement employers who compete with federal agencies for workers may face indirect competitive pressure if federal compensation becomes more attractive.
Supporters argue
Supporters argue that lower-grade Border Patrol agents perform the same demanding, around-the-clock border security work as their GS-12 counterparts but are excluded from equivalent overtime compensation solely because of their pay grade — a disparity that undermines morale and contributes to staffing shortages. They contend that parity in overtime pay is a straightforward matter of fairness and that improving compensation at entry and mid levels is essential to recruiting and retaining agents in a chronically understaffed agency.
Opponents argue
Opponents argue that the GS-12 threshold in existing law was deliberately set to target the overtime benefit at more experienced, senior agents whose retention is most critical to operational continuity, and that expanding eligibility to all grades increases federal payroll costs without a demonstrated link to improved border outcomes. They contend that broader workforce and compensation challenges at CBP require comprehensive agency-wide solutions rather than piecemeal pay adjustments that add fiscal obligations without structural accountability.
Constitutional context
No significant constitutional issue is raised by this bill. Congress has clear authority under Article I to set the terms and conditions of federal employment and to appropriate funds for federal compensation. No enumerated-power limits, takings concerns, or major questions doctrine issues are implicated by a targeted modification to a federal pay statute.
Checks and balances
Congress gains authority to expand the scope of a federal pay provision; the Office of Personnel Management and the Department of Homeland Security would implement the change administratively, with appropriations oversight remaining with Congress.
Historical precedent
The Federal Employees Pay Comparability Act of 1990 and subsequent amendments have periodically adjusted federal pay structures and overtime eligibility, though no directly analogous legislation specifically targeting Border Patrol grade-level overtime parity has been identified.
