What it does
This bill would classify consumer products containing 10% or more sodium nitrite by weight as banned hazardous products under the Consumer Product Safety Act. It exempts commercial/industrial uses not sold to consumers, and exempts food, drugs, cosmetics, and meat/poultry/egg products regulated under other federal food safety laws. The ban would take effect 90 days after enactment.

Opponents argue that banning a chemical based on concentration thresholds may be an overly blunt tool that could sweep in legitimate niche uses, such as specialty meat-curing suppliers or hobbyist chemists, and that the underlying problem is better addressed through platform-level sales restrictions or warning-label requirements rather than a categorical federal ban. They contend that determined individuals could still obtain the substance through international sellers or in bulk industrial channels, limiting the bill's practical effectiveness.

Congress's authority rests on the Commerce Clause power to regulate the interstate sale of consumer products, consistent with the broad economic-regulation authority recognized in Wickard v. Filburn (1942); because the ban targets commercial sale of a physical product rather than non-economic activity, it falls comfortably within that authority under United States v. Lopez (1995)'s outer-limits framework.
