HR-1455-119
Received in the Senate and Read twice and referred to the Committee on Commerce, Science, and Transportation.
Sponsored by Earl Carter (R-GA)
What it does
This bill would codify into law the existing Institute for Telecommunication Sciences (ITS), a spectrum research test center within the National Telecommunications and Information Administration, formally establishing its functions in statute. It would also direct the Assistant Secretary of Commerce for Communications and Information, acting through ITS, to create an initiative supporting development of emergency communication and tracking technologies for locating trapped individuals in mines, high-rise buildings, or collapsed structures, including a needs assessment and a public report to Congress within 18 months.
Who benefits
Federal agencies and the FCC that rely on ITS spectrum propagation research for spectrum-sharing and clearing decisions; commercial wireless and telecommunications companies seeking access to federal spectrum; emergency responders, mine workers, and disaster response agencies who could benefit from improved communication and tracking technology; private-sector technology developers who may partner with ITS on the new initiative.
Who is hurt
No group is meaningfully harmed by this bill; it largely codifies an already-existing entity and adds a modest new research initiative. Federal agencies that currently hold spectrum may face increased pressure over time to share or clear frequencies as spectrum research and policy advocacy expand, and taxpayers bear the modest cost of the new initiative and reporting requirement.
Supporters argue
Supporters argue that codifying ITS in statute, rather than leaving it as an administrative creation, ensures continuity and legal clarity for the government's premier spectrum research laboratory, which informs decisions about clearing or sharing federal spectrum for commercial 5G and next-generation wireless use. They contend the emergency communication and tracking initiative addresses a real safety gap, since conventional radio communication fails in mines, collapsed buildings, and other shielded environments, potentially saving lives in disasters and mine accidents.
Opponents argue
Opponents argue that codifying an already-functioning test center is largely a symbolic exercise that adds little practical value while potentially locking in a specific bureaucratic structure that could reduce future administrative flexibility to reorganize spectrum research functions. They contend the emergency technology initiative's outcome depends heavily on funding levels not specified in the bill, and that a mere needs-assessment report may produce limited real-world results without a dedicated appropriation.
Constitutional context
Congress has authority under the Commerce Clause to regulate spectrum allocation and telecommunications infrastructure, and this bill involves no individual rights restrictions, surveillance, or content moderation issues that would implicate the Fourth or First Amendment. This is a routine exercise of Congress's power to organize and codify an executive branch agency function, raising no significant constitutional question.
Checks and balances
Congress would formally establish ITS's authority and functions in statute, somewhat constraining the executive branch's discretion to alter or eliminate the office administratively, while the Assistant Secretary retains broad discretion in implementation and delegation of functions.
Historical precedent
The Institute for Telecommunication Sciences has operated administratively within NTIA for decades, and this bill follows a common congressional practice of codifying existing executive agency functions into statute.
