HR-1682-119
Received in the Senate and Read twice and referred to the Committee on Energy and Natural Resources.
Sponsored by Gabe Evans (R-CO)
What it does
This bill would amend the Federal Lands Recreation Enhancement Act to provide free lifetime passes to National Parks and other federal recreational lands to surviving family members of military service members who died while serving. Eligibility would be tied to two existing federal survivor benefit programs: recipients of the military death gratuity (a lump-sum payment to next-of-kin) and recipients of Dependency and Indemnity Compensation (a monthly VA benefit for surviving spouses, children, and dependent parents of service members who died in the line of duty).
Who benefits
Surviving spouses, children, and dependent parents of service members who died on active duty or from service-connected causes — the groups already receiving death gratuity or Dependency and Indemnity Compensation. This includes Gold Star families broadly. Federal land management agencies (National Park Service, Bureau of Land Management, U.S. Forest Service, etc.) may benefit indirectly from the goodwill and public support the program generates. Recreational outfitters and businesses near federal lands may see modest indirect benefit from increased visitation by eligible families.
Who is hurt
Federal land management agencies would forgo a small amount of entrance fee revenue for each pass issued. Current pass fee revenue funds park operations and maintenance, so a reduction — however modest — could marginally affect those budgets. Taxpayers broadly bear any resulting funding gap if fee revenue declines are not offset. The population of eligible survivors is relatively small, so the fiscal effect is expected to be minor.
Supporters argue
Supporters argue that families who lost a loved one in military service have already paid an irreplaceable price and deserve lasting recognition from the nation they sacrificed for. They contend that the existing America the Beautiful pass program already provides free lifetime access to veterans with service-connected disabilities and active-duty personnel, making this a logical and equitable extension to Gold Star families who are currently excluded. The cost to the federal government would be minimal given the relatively small eligible population, while the symbolic and practical benefit to grieving families is significant.
Opponents argue
Opponents argue that while the intent is honorable, expanding categorical pass eligibility sets a precedent for further carve-outs that could cumulatively erode the fee revenue that funds park maintenance and operations — a system already facing a multi-billion-dollar deferred maintenance backlog. They contend that survivor benefits are already addressed through existing compensation programs (death gratuity and DIC), and that non-monetary recognition could be better structured through a dedicated commemorative program rather than by reducing the funding base of the National Park System.
Constitutional context
No significant constitutional issues are raised by this bill. Congress has broad authority under the Property Clause (Art. IV, §3, cl. 2) to manage federal lands and set terms of access. The bill does not implicate the war powers provisions, detention rights, or Commander-in-Chief authorities outlined in the Defense constitutional framework; it is a benefits and land-access measure, not a military operations or spending bill in the traditional sense.
Checks and balances
Congress expands eligibility for a federal lands benefit program; the relevant land management agencies (National Park Service, BLM, Forest Service, etc.) administer pass issuance; the VA and DoD eligibility determinations for death gratuity and DIC serve as the gatekeeping mechanism, limiting administrative burden on land agencies.
Historical precedent
The Federal Lands Recreation Enhancement Act already provides free lifetime passes to U.S. military veterans with service-connected disabilities and active-duty personnel; this bill extends that framework to a new category of survivors rather than creating an entirely new program.
