HR-1945-119
Message on Senate action sent to the House.
Sponsored by Robert Onder (R-MO)
What it does
This bill would officially designate America's National Churchill Museum at Westminster College in Fulton, Missouri — including the existing Winston Churchill Memorial — as a National Historic Landmark. It would authorize the Secretary of the Interior to enter into cooperative agreements with public or private entities to protect historic resources and provide educational programs at the site, and to provide technical and financial assistance under those agreements. The bill would also direct the Secretary to conduct a special resource study within three years to evaluate the site's national significance and assess whether it should become a unit of the National Park System.
Who benefits
Westminster College in Fulton, Missouri, which gains federal recognition and potential access to technical and financial assistance. The city of Fulton and the state of Missouri, which may see increased tourism and economic activity. Historians, educators, and students interested in Winston Churchill and Cold War history. The general public, which would gain improved access to educational and interpretive programs at the site. Nonprofit and private organizations that could enter into cooperative agreements with the federal government for site preservation.
Who is hurt
Federal taxpayers, who may bear costs associated with the special resource study and any financial assistance provided under cooperative agreements. The bill explicitly preserves property owner rights and existing administration, so no current stakeholders at the site face restrictions. If the study ultimately recommends National Park System designation, future federal budgets could face additional operational costs, potentially competing with funding for other park units.
Supporters argue
Supporters argue that the Churchill Museum holds unique national significance as the site of Winston Churchill's 1946 "Iron Curtain" speech — a pivotal moment in Cold War history that shaped U.S. foreign policy for decades. They contend that formal National Historic Landmark designation provides the site with federal recognition it merits, helps secure its long-term preservation, and expands public access to an important piece of shared democratic history without restricting the property owner's rights or mandating federal takeover of the site.
Opponents argue
Opponents argue that the federal government already maintains an extensive portfolio of National Historic Landmarks and National Park units, and that adding sites through individual congressional designations — rather than through the standard administrative review process — sets a precedent that bypasses the merit-based evaluation system. They contend that the special resource study, cooperative agreements, and potential financial assistance represent incremental federal spending and administrative burden that could be avoided if the site pursued designation through existing channels without congressional intervention.
Constitutional context
No significant constitutional issues are raised by this bill. Congress has broad authority under the Property Clause (Art. IV, §3, cl. 2) and the Necessary and Proper Clause (Art. I, §8, cl. 18) to designate and manage sites of national historic significance. The bill explicitly preserves property owner rights, avoiding any Takings Clause concern under the Fifth Amendment.
Checks and balances
The Secretary of the Interior gains discretionary authority to enter cooperative agreements and provide financial assistance, subject to congressional oversight through required reporting to the Senate Committee on Energy and Natural Resources and the House Committee on Natural Resources within three years.
Historical precedent
Congress has routinely designated National Historic Landmarks and directed special resource studies for individual sites through standalone legislation, such as the Manhattan Project National Historical Park Act (2014), which similarly authorized cooperative agreements and studies before formal park designation.
