HR-309-119
Received in the Senate.
Sponsored by Troy Nehls (R-TX)
What it does
This bill would authorize the Secretary of the Interior to award annual grants of $6,000,000 to the National Law Enforcement Officers Memorial Fund for seven fiscal years, to support the National Law Enforcement Museum's education, memorial, and officer safety/wellness programs. Grants are conditioned on the museum offering free admission to law enforcement officers, retirees, and families of fallen officers, plus at least one weekly free admission period for the public, and on allowing annual federal audits of the Fund's finances. The bill explicitly states no additional funds are authorized beyond what Congress appropriates separately, meaning the grants only occur if Congress later approves the actual spending.
Who benefits
The National Law Enforcement Museum and its parent Fund, which would receive up to $42 million over seven years if fully appropriated; visitors who benefit from free admission, including active and retired law enforcement officers, families of officers killed in the line of duty, and members of the public who use the weekly free admission hours; museum staff and researchers involved in curriculum development, exhibits, and digitization projects; and educators and students who use the museum's teaching resources.
Who is hurt
Federal taxpayers who would fund the grants if appropriated; other museums, memorials, or nonprofit educational institutions competing for limited federal cultural and educational funding who do not receive comparable support; and potentially other Interior Department priorities if appropriators reallocate funds within a constrained discretionary budget.
Supporters argue
Supporters argue that law enforcement officers face significant occupational risks and that a dedicated national museum preserving this history, promoting officer safety and wellness training, and honoring fallen officers serves an important public education function. They contend the funding conditions—requiring free admission for officers and their families and at least weekly free public access, plus mandatory federal audits—ensure accountability and broad public benefit rather than simply subsidizing a private institution.
Opponents argue
Opponents argue that dedicating up to $42 million in federal funds to a single museum represents a narrow use of taxpayer money that could instead support broader public safety, victim services, or general educational programs benefiting more people. They contend that singling out one institution for recurring federal grants, rather than funding competitively available to multiple museums or programs, raises questions about whether this is the most effective use of limited discretionary appropriations.
Constitutional context
This bill raises no significant constitutional question; Congress has broad authority under the Spending Clause (Article I, Section 8) to appropriate funds for museums and educational programs, and the grant conditions imposed here (free admission, audits) are typical spending-power conditions rather than coercive mandates on states or individuals.
Checks and balances
Congress authorizes the spending program and retains control because the bill requires separate future appropriations; the Secretary of the Interior administers grant review and approval, with reporting obligations to congressional committees providing ongoing oversight.
Historical precedent
Congress has previously authorized federal support for other national memorial and museum institutions, such as funding structures for the National World War II Memorial and similar commemorative sites, though this bill's specific grant mechanism to a single private museum fund is a distinct arrangement.
