HR-3295-107
Became Public Law No: 107-252.
What it does
This law requires states to upgrade voting systems to allow error verification and correction, produce a paper record for audits, and be accessible to voters with disabilities. It also requires provisional ballots for voters not on registration lists, creates statewide computerized voter registration databases, establishes federal grant programs to help states pay for these changes, creates the Election Assistance Commission, and adds protections for military and overseas voters' absentee ballots.
Who benefits
Voters using outdated punch-card or lever machines who would get more accurate, verifiable voting systems; voters with disabilities who gain accessible voting equipment; voters whose registration status is disputed and can now cast a provisional ballot; military and overseas voters who gain expanded absentee ballot protections; state and local election officials who receive federal funding for equipment upgrades; election equipment vendors who benefit from new purchase contracts.
Who is hurt
State and local governments that must bear implementation costs beyond federal grants, including smaller jurisdictions with limited budgets; election officials who must build new statewide databases and retrain poll workers under new deadlines; voters in states transitioning systems who may face confusion during the changeover; taxpayers funding the federal grant programs and new federal agency.
Supporters argue
Supporters argue the 2000 presidential election exposed serious flaws in outdated punch-card systems, including thousands of miscounted or unreadable ballots, and that uniform standards for verification, accessibility, and provisional voting are necessary to ensure every legitimate vote is counted. They contend federal funding for equipment upgrades and a dedicated federal clearinghouse would modernize elections nationwide while preserving state control over administration.
Opponents argue
Opponents argue the law imposes new federal mandates and reporting requirements on states without fully funding compliance costs, straining local election budgets and creating one-size-fits-all rules that ignore differences among states. They contend provisions like voter ID options and provisional ballot rules could be implemented unevenly, potentially causing confusion or disputes over eligibility in close elections.
Constitutional context
Congress relies on the Elections Clause (Article I, Section 4) to regulate the "times, places, and manner" of federal elections, and this law's uniform technology and registration standards fall within that authority; Crawford v. Marion County Election Board (2008) later addressed related state ID requirements enabled partly by this law's grant provisions.
Checks and balances
Congress creates new federal standards and a new independent agency (the Election Assistance Commission), while the Justice Department gains civil enforcement authority; states retain primary implementation control and courts review disputes under the Elections Clause and constitutional voting protections.
Historical precedent
This law was enacted directly in response to the disputed 2000 presidential election and punch-card ballot problems in Florida, marking the first major federal overhaul of election administration standards since the National Voter Registration Act of 1993.
