HR-4467-119
Message on Senate action sent to the House.
Sponsored by Bennie Thompson (D-MS)
What it does
This bill would direct the Secretary of the Interior to transfer two small parcels of federal land — approximately 1.69 acres and 5.74 acres — within Vicksburg National Military Park to the State of Mississippi at no cost. It would also remove those parcels from the park's official boundary. The transferred land would be required to support public access to and the visitor experience at the park, subject to use restrictions set by the Secretary.
Who benefits
The State of Mississippi, which would gain ownership of approximately 7.43 acres of federal land at no cost. Mississippi state agencies that may develop or manage the parcels for park access or visitor services. Local businesses and tourism operators near Vicksburg who could benefit from improved visitor access infrastructure. Park visitors who may gain enhanced access points or amenities. The National Park Service, which would shed management responsibility for these parcels while retaining oversight authority over their use.
Who is hurt
Federal taxpayers, who would receive no compensation for the transfer of publicly owned land. Future generations who might otherwise benefit from federal stewardship of these parcels. Environmental or historic preservation advocates who may prefer federal control over land adjacent to a Civil War battlefield. Any private parties who had anticipated potential public use of these parcels under federal management.
Supporters argue
Supporters argue that transferring these small parcels to Mississippi would allow the state to develop visitor access infrastructure — such as parking, pathways, or interpretive facilities — more efficiently than the federal government, since states often have greater flexibility in land development. They contend the bill includes strong protective conditions requiring the land to be used consistently with the park's interpretive mission and prohibiting uses that would harm park resources, ensuring federal oversight is preserved even after the transfer.
Opponents argue
Opponents argue that conveying federal land to a state without compensation sets a precedent for the disposal of publicly owned assets that belong to all Americans, not just one state. They contend that once land is removed from the park boundary, long-term federal protections weaken, and future state administrations could seek to modify or circumvent the use restrictions — potentially allowing commercial or incompatible development adjacent to a nationally significant Civil War battlefield.
Constitutional context
Congress has broad authority over federal property under the Property Clause (Art. IV, §3, cl. 2), which grants Congress the power to dispose of territory or other property belonging to the United States. No active constitutional tension exists here; this is a routine exercise of that authority with no significant Commerce Clause, Takings, or major questions doctrine implications.
Checks and balances
Congress directs the land transfer; the Secretary of the Interior retains authority to set and enforce use restrictions on the conveyed parcels, preserving some executive branch oversight even after the boundary modification.
Historical precedent
Congress routinely adjusts national park boundaries and conveys small federal land parcels to states or localities through standalone boundary modification acts; dozens of similar bills have been enacted across multiple Congresses.
