HR-5823-119
Referred to the Subcommittee on Forestry and Horticulture.
Sponsored by Joe Neguse (D-CO)
What it does
This bill would amend the Agricultural Credit Act of 1978 to create a new Emergency Forest Watershed Program, letting the Forest Service partner with states, tribes, and water districts to quickly repair erosion, flooding, and watershed damage on National Forest System land after natural disasters. It authorizes the Secretary of Agriculture to make payments to these local "sponsors" to carry out repair work, waives matching fund requirements, sets a 2-year completion deadline and up to 3 years of follow-up monitoring, limits sponsor liability, and treats these emergency measures as exempt from standard environmental review timelines under existing Forest Service emergency-response regulations.
Who benefits
Downstream communities, water utilities, and property owners at risk from post-disaster flooding or erosion originating on National Forest land; state and local governments, tribal governments, and water districts that would receive federal payments and liability protection to do the repair work; and Forest Service contractors and local economies involved in watershed restoration projects.
Who is hurt
Federal taxpayers who would fund the payments, though costs depend on the frequency and scale of qualifying disasters. Parties potentially harmed by expedited watershed projects that receive limited environmental review (e.g., neighboring landowners or environmental groups) would have fewer avenues for challenge given the streamlined NEPA treatment. Sponsors themselves bear risk if they act before signing agreements, since they must assume associated costs and liability.
Supporters argue
Supporters argue that wildfires, floods, and storms increasingly damage National Forest watersheds, threatening downstream drinking water and property, and that current processes are too slow to prevent escalating harm. They contend that waiving matching requirements, streamlining agreements, and exempting emergency work from lengthy environmental review timelines would let states, tribes, and water districts act quickly to stabilize soil and prevent worse flooding before damage compounds.
Opponents argue
Opponents argue that treating these projects as categorically exempt emergency actions under NEPA regulations could reduce environmental scrutiny and public input on forest land management decisions, even when the underlying justification is disaster response. They contend that waived matching requirements and liability protections for sponsors could shift financial risk to federal taxpayers without sufficient oversight of how funds are spent or whether repair methods are ecologically sound.
Constitutional context
Congress's authority to manage federal lands under the Property Clause (Art. IV, §3, cl. 2) and to appropriate funds under Article I, §8 governs this program; because it directs agency action through specific statutory criteria rather than broad discretion, it does not raise the kind of major-questions concerns seen in West Virginia v. EPA (2022).
Checks and balances
Congress delegates implementation authority to the Secretary of Agriculture (acting through the Forest Service) to enter agreements and disburse payments, with the statute itself defining eligibility, timelines, and liability limits, leaving limited independent discretion subject to normal appropriations oversight.
Historical precedent
This program closely parallels the existing Emergency Watershed Protection Program administered by the Natural Resources Conservation Service, which provides similar disaster-recovery assistance for non-federal lands.
