HR-7712-119
Referred to the Subcommittee on Forestry and Horticulture.
Sponsored by Kim Schrier (D-WA)
What it does
This bill would direct the Forest Service to partner with federal and state agencies, tribes, universities, nonprofits, and private nurseries to provide training, research, and technical assistance for reforestation and tree nursery programs. It would also create a grant program within 2 years for state forestry agencies, tribes, and qualifying private nurseries to expand seed and seedling production, funded by up to $5 million per year from the existing Reforestation Trust Fund.
Who benefits
State forestry agencies, Indian Tribes, and private tree nurseries that would be eligible for grants; the reforestation supply chain workforce; landowners and organizations conducting reforestation, afforestation, or agroforestry projects; and international forestry programs receiving technical and financial assistance through the Forest Service.
Who is hurt
No group appears meaningfully harmed, though nurseries or tribes that do not meet eligibility criteria would not receive grant funds, and other programs funded by the Reforestation Trust Fund could see reduced available balances since up to $5 million annually would be redirected to this new grant program.
Supporters argue
Supporters argue that the nation's reforestation supply chain faces a well-documented shortage of seeds, seedlings, and skilled nursery workers just as demand for reforestation grows due to wildfires and land restoration needs. They contend that dedicated grants and coordinated technical assistance would expand nursery capacity, improve tree genetics for climate resilience, and speed up seed collection permitting on federal lands.
Opponents argue
Opponents argue that the bill creates another narrow grant program with broad discretionary criteria, including a catch-all category allowing the Secretary to fund "any other activity determined appropriate," which could reduce accountability for how funds are spent. They contend that diverting up to $5 million annually from the Reforestation Trust Fund could limit resources available for other reforestation priorities already authorized under existing law.
Constitutional context
This bill falls under Congress's spending power (Article I, Section 8) to appropriate funds for programs it deems to serve the general welfare, and its authority to manage federal lands under the Property Clause (Article IV, Section 3). It raises no significant constitutional question, as it establishes a voluntary grant program and interagency coordination without regulating private commercial activity in a way that would trigger Commerce Clause or takings scrutiny.
Checks and balances
Congress directs and funds the program while delegating implementation discretion to the Secretary of Agriculture and Forest Service, with oversight retained through appropriations and the $5 million annual cap on Trust Fund obligations.
Historical precedent
The Reforestation Trust Fund itself was established by the Public Rangelands Improvement Act framework referenced in the bill (16 U.S.C. 1606a), and this bill builds on that existing funding mechanism rather than creating an entirely new precedent.
