HR-9328-119
Received in the Senate and Read twice and referred to the Committee on Commerce, Science, and Transportation.
Sponsored by Sheri Biggs (R-SC)
What it does
This bill would authorize the TSA Administrator to establish a three-year pilot program at select airports to expedite security screening for active-duty military personnel and their accompanying family members. The Administrator may only create the program if doing so does not compromise existing security protocols, and all passengers must still be screened under the TSA's Secure Flight vetting system. Priority would be given to airports near military installations, and the Administrator must brief relevant congressional committees within nine months of the program's launch.
Who benefits
Active-duty military personnel who travel frequently, particularly those stationed near participating airports. Family members accompanying active-duty service members who would experience shorter wait times. Airports near military installations that may see smoother passenger flow. Indirectly, other travelers in standard lanes may benefit if military passengers are routed to dedicated lanes, reducing overall congestion.
Who is hurt
Civilian travelers who do not qualify for expedited screening and may perceive the dedicated lanes as inequitable. TSA PreCheck enrollees who pay fees for expedited access and may see their lanes become more crowded if military passengers are routed there. TSA staff at pilot airports who may face increased administrative and logistical demands from managing additional dedicated lanes. Airports not selected for the pilot program would not see any operational benefit.
Supporters argue
Supporters argue that active-duty military personnel frequently travel under time-sensitive orders and that long security lines can cause missed flights with serious operational consequences for military readiness. They contend that the bill's built-in security safeguards — mandatory Secure Flight vetting and a prohibition on bypassing boarding pass eligibility checks — ensure that expedited access does not come at the cost of aviation security, making this a low-risk, high-benefit adjustment for a population that serves at significant personal sacrifice.
Opponents argue
Opponents argue that creating a preferential screening category based on military status sets a precedent for tiered access to public infrastructure and raises fairness concerns for other groups — such as first responders or medical personnel — who may have equally urgent travel needs. They contend that the bill's broad discretion granted to the TSA Administrator, with minimal mandatory standards for airport selection or program design, could result in inconsistent implementation and that the three-year pilot may lack the rigor needed to produce actionable data for Congress.
Constitutional context
No significant constitutional issue is raised by this bill. Congress has broad authority to regulate aviation security under the Commerce Clause, and directing a federal agency to establish a discretionary pilot program falls squarely within that authority. No provisions in the bill implicate the war powers framework or the cases identified in the defense constitutional context.
Checks and balances
The executive branch (TSA Administrator) gains discretionary authority to design and run the pilot program, but Congress retains oversight through a mandatory briefing requirement and the program's three-year sunset provision, after which Congress would need to act to make it permanent.
Historical precedent
TSA has previously extended informal courtesies to military travelers at some airports, but no prior federal statute has established a formal, structured pilot program for dedicated military security screening lanes.
