What it does
This bill would amend the Elementary and Secondary Education Act of 1965 (ESEA) to encourage local educational agencies (LEAs) receiving Title I funds to provide students at least 60 minutes of physical activity per school day. It would add physical activity planning as an optional element of LEA plans, expand eligible uses of existing student health and safety grant funds to include daily recess or unstructured physical activity programs, and define "physical activity time" to include recess and physical education courses. The bill does not mandate compliance — LEAs may include a physical activity plan only "if determined appropriate."

Because this bill uses purely voluntary, non-coercive language ("encouraged" and "if determined appropriate"), it is unlikely to raise a Spending Clause coercion concern.
