HRES-1099-119
Motion to reconsider laid on the table Agreed to without objection.
Sponsored by Brian Mast (R-FL)
What it does
H. Res. 1099 is a simple resolution in which the House of Representatives would formally declare it to be U.S. policy that Iran continues to be the world's largest state sponsor of terrorism. It cites Iran's financial and military support for Hezbollah, Hamas, and the Houthis; the deaths of American servicemembers attributed to Iranian-backed proxy forces; alleged assassination plots on U.S. soil; Iran's harboring of al-Qaeda leaders; and Iran's nuclear enrichment activities. As a simple House resolution, it would not have the force of law, create new programs, or appropriate funds.
Who benefits
Members of Congress who support a harder U.S. line toward Iran, as the resolution provides a formal legislative record for that position. Families of U.S. servicemembers killed in Iranian-backed proxy attacks, who may view the resolution as official recognition of their losses. U.S. allies in the Middle East — particularly Israel and Gulf states — who favor strong American condemnation of Iran. Advocacy organizations focused on counterterrorism and Iran policy who can cite the resolution in public debate.
Who is hurt
Diplomatic efforts that rely on quiet engagement with Iran, which could be complicated by a formal congressional declaration of Iran's status. U.S. negotiators pursuing arms control or nuclear talks with Iran, who may face a harder bargaining environment. Iranian-American communities who may experience increased social stigma or scrutiny. Organizations engaged in humanitarian work in Iran, which could face a more restrictive political climate around any Iran-related activity.
Supporters argue
Supporters argue that Iran's decades-long record of financing and arming proxy forces — including groups responsible for the deaths of at least 603 U.S. servicemembers in Iraq per Pentagon data — demands unambiguous congressional condemnation. They contend that formal declarations of policy reinforce diplomatic pressure, signal resolve to allies and adversaries alike, and create a legislative record that can inform future sanctions, military authorizations, or treaty decisions. The January 2024 Tower 22 attack, which killed three U.S. soldiers, and Iran's ongoing uranium enrichment in defiance of UN Security Council resolutions, they argue, make this declaration both timely and factually grounded.
Opponents argue
Opponents argue that a non-binding resolution carries no legal force and functions primarily as political signaling rather than substantive policy, potentially inflaming tensions without providing diplomatic tools to reduce them. They contend that formally enshrining Iran's "largest state sponsor" label in a House declaration could constrain future administrations' flexibility to negotiate on nuclear nonproliferation or hostage releases — areas where back-channel diplomacy has historically produced results. Critics may also note that several factual claims in the resolution's "whereas" clauses — such as Iran being the singular "largest" sponsor — reflect contested intelligence assessments rather than universally agreed-upon findings.
Constitutional context
Simple House resolutions express the sense of one chamber and do not carry the force of law, so no direct constitutional conflict arises here. The resolution touches on the foreign policy powers shared between Congress and the Executive: Congress has broad authority to declare policy positions under its foreign commerce and war powers (Art. I, §8), while the President holds exclusive recognition and diplomatic powers under Zivotofsky v. Kerry (2015). A non-binding resolution does not override executive recognition power, but it can signal congressional intent relevant to future legislation.
Checks and balances
The House gains a formal policy record on Iran's terrorism designation, but because this is a simple resolution — not a law — the Executive Branch retains full discretion over actual foreign policy conduct, diplomatic engagement, and sanctions enforcement; no new authority is transferred or constrained.
Historical precedent
Congress has passed numerous non-binding resolutions designating state sponsors of terrorism and condemning Iranian conduct, including resolutions following the 1979 hostage crisis and various Iran sanctions acts, though none are a direct procedural analogue to this specific declaration.
