HRES-1272-119
Referred to the House Committee on Foreign Affairs.
Sponsored by Carlos Gimenez (R-FL)
What it does
This resolution would formally express the House of Representatives' recognition of the 200th anniversary of diplomatic relations between the United States and Peru, established in 1826. It would commend the contributions of Peruvian Americans, reaffirm U.S. commitment to cooperation with Peru, and encourage continued partnership on regional security, democratic governance, and economic prosperity. The resolution carries no binding legal force and does not appropriate funds or change existing law.
Who benefits
Peruvian Americans, whose cultural, economic, and social contributions receive formal congressional recognition. The Peruvian government and its diplomatic corps, who gain a symbolic affirmation of the bilateral relationship. U.S. businesses with trade and investment ties to Peru under the 2009 U.S.-Peru Trade Promotion Agreement. Defense and security partners who benefit from the reaffirmation of Peru's Major Non-NATO Ally status.
Who is hurt
No group faces a direct material harm from a commemorative resolution. Critics of U.S.-Peru relations — including human rights organizations concerned about governance issues in Peru — may argue the resolution implicitly endorses the current state of the bilateral relationship without acknowledging those concerns.
Supporters argue
Supporters argue that 200 years of continuous diplomatic relations represents a significant milestone worthy of formal recognition, and that Peru's designation as a Major Non-NATO Ally in 2026 underscores its growing strategic importance in the Western Hemisphere. They contend that commemorating the relationship reinforces people-to-people ties with the Peruvian American community and signals U.S. commitment to democratic partnerships in Latin America at a time of regional instability.
Opponents argue
Opponents argue that a formal House resolution celebrating the bilateral relationship glosses over documented governance and human rights concerns in Peru, potentially lending unqualified congressional endorsement to a partnership that warrants more nuanced scrutiny. They contend that symbolic resolutions consume legislative time and resources without producing enforceable policy outcomes, and that substantive concerns about democratic backsliding or regional security should be addressed through binding legislation rather than celebratory language.
Constitutional context
No significant constitutional issue is raised by this resolution. The House has broad authority to pass non-binding expressions of sentiment. The Reception Clause (Art. II, §3) and the President's exclusive recognition power under Zivotofsky v. Kerry (2015) are not implicated, as this resolution does not purport to direct or override executive foreign policy decisions.
Checks and balances
Congress expresses a non-binding sentiment; no branch gains or loses power, and the resolution imposes no obligations on the executive branch or any foreign government.
Historical precedent
Congress regularly passes commemorative resolutions marking diplomatic anniversaries; for example, H. Res. 401 (114th Congress) celebrated 75 years of U.S.-Iceland diplomatic relations in a structurally identical format.
