HRES-1339-119
Referred to the House Committee on Foreign Affairs.
Sponsored by Marlin Stutzman (R-IN)
What it does
This resolution would express the sense of the House of Representatives in support of transitioning the U.S.-Israel relationship from traditional military aid toward mutual defense cooperation, joint technology development, and shared economic investment. It would formally recognize Israel's participation in joint military operations against Iran and commend Israeli Prime Minister Benjamin Netanyahu's proposal to phase out Israel's reliance on U.S. financial military assistance over 10 years. It would also condemn antisemitism in all its forms, including physical attacks, harassment, and the delegitimization of Israel's right to exist.
Who benefits
U.S. and Israeli defense contractors and technology firms that would gain from expanded codevelopment and coproduction agreements. American workers in the defense industrial base who could benefit from joint manufacturing arrangements. Jewish Americans and Jewish communities who would see formal congressional condemnation of antisemitism. The Israeli government, which would receive formal U.S. legislative endorsement of its proposed aid restructuring. U.S. policymakers seeking a congressional signal in favor of a new memorandum of understanding with Israel.
Who is hurt
Organizations and individuals who oppose U.S. military cooperation with Israel, particularly regarding operations against Iran, who would see their position formally rejected by the House. Taxpayers and budget analysts who favor reducing defense spending may find the resolution's endorsement of expanded joint investment counterproductive to that goal. Humanitarian and foreign policy advocates who argue that U.S. military aid conditionality is a lever for human rights accountability would see that leverage formally discouraged. Members of Congress who prefer a more restrained or neutral posture toward the Israeli-Palestinian conflict may find the resolution's framing politically constraining.
Supporters argue
Supporters argue that transitioning from one-way financial assistance to mutual defense codevelopment strengthens both nations' security while reducing U.S. expenditure — a fiscally responsible evolution of the relationship. They contend that Israel's participation in joint operations that degraded Iran's nuclear weapons program and ballistic missile capabilities directly advanced U.S. national security interests, and that formal congressional recognition reinforces the credibility of that partnership. They further argue that the resolution's condemnation of antisemitism addresses a documented and rising threat, with FBI hate crime data consistently showing Jewish Americans as the most targeted religious group in the United States.
Opponents argue
Opponents argue that a sense-of-the-House resolution endorsing a specific foreign leader's policy proposal — by name — is an unusual step that blurs the line between congressional foreign policy expression and executive diplomatic negotiations, potentially complicating the President's exclusive authority over treaty and agreement negotiations under the Treaty Clause. They contend that formally commending joint military operations against Iran without a congressional declaration of war or explicit AUMF raises unresolved war powers questions under Article I, Section 8. They also argue that the resolution's broad framing conflates criticism of Israeli government policy with antisemitism, which critics say could chill constitutionally protected political speech.
Constitutional context
The Treaty Clause (Art. II, §2, cl. 2) vests the President with the power to negotiate international agreements, subject to Senate ratification; a House resolution expressing support for a specific restructuring framework does not bind the executive but may signal congressional intent. The Declare War Clause (Art. I, §8, cl. 11) is relevant because the resolution formally commends joint military operations against Iran without reference to a congressional authorization for the use of military force, touching an ongoing tension between executive Commander-in-Chief authority and Congress's war declaration power.
Checks and balances
The resolution is purely advisory — it does not appropriate funds, create law, or bind the executive — so no branch formally gains or loses power, though it signals House sentiment that could influence executive negotiations over a new U.S.-Israel memorandum of understanding.
Historical precedent
Congress has regularly passed sense-of-Congress resolutions affirming the U.S.-Israel relationship, including H. Res. 34 (115th Congress), which expressed support for Israel's right to self-defense, though resolutions formally endorsing a specific foreign leader's aid-restructuring proposal by name are less common.
