S-1260-117
Passed Senate, under the order of 5/28/21, having achieved 60 votes in the affirmative, with an amendment by Yea-Nay Vote. 68 - 32. Record Vote Number: 226. (text: CR S4049-4499)
Sponsored by Charles Schumer (D-NY)
What it does
This bill would create a new National Science Foundation Directorate for Technology and Innovation, fund semiconductor and wireless supply chain manufacturing, establish regional technology hubs, and authorize billions in research funding across science and space programs. It also would impose export controls, sanctions, and research-security restrictions related to China, require "Buy America" sourcing rules, restrict TikTok on government devices, and set new international trade and diplomatic policies toward the Indo-Pacific region.
Who benefits
Semiconductor and wireless manufacturers receiving CHIPS Act funding; universities and researchers receiving NSF grants and technology hub investments; STEM students and early-career researchers; domestic manufacturers benefiting from Buy America rules; national security agencies gaining new tools to counter Chinese technology transfer and espionage; Taiwan and Indo-Pacific allies receiving increased U.S. support; workers in targeted regional tech hubs.
Who is hurt
U.S. universities and researchers with existing China-based collaborations or Confucius Institute partnerships, who would face funding restrictions; companies reliant on Chinese supply chains or foreign national talent programs; foreign nationals from restricted countries seeking access to emerging U.S. technologies; taxpayers bearing the cost of hundreds of billions in new authorized spending; import-dependent businesses facing new country-of-origin and forced-labor compliance requirements; federal contractors affected by new Buy America sourcing mandates.
Supporters argue
Supporters argue the bill addresses a genuine strategic vulnerability — America's reliance on foreign, especially Chinese, semiconductor and technology supply chains — by funding domestic manufacturing, research, and workforce development at a scale commensurate with the challenge. They contend that without significant federal investment, the U.S. risks falling behind in critical technologies like AI, quantum computing, and biotechnology, citing the semiconductor shortage's disruption of manufacturing as evidence of urgent need.
Opponents argue
Opponents argue the bill's enormous scope and cost — spanning space policy, trade law, sanctions, education, and dozens of unrelated provisions bundled together — makes it difficult to evaluate individual provisions on their merits and invites wasteful or duplicative spending. They contend some research-security and visa-restriction provisions could chill legitimate international academic collaboration and disproportionately burden researchers of Chinese descent without clear evidence of proportional security benefit.
Constitutional context
Most provisions raise no significant constitutional question, as they fall within Congress's spending, commerce, and foreign affairs powers; however, provisions restricting foreign nationals' access to emerging technologies and imposing sanctions could implicate Due Process Clause concerns if enforcement mechanisms are vague or overbroad.
Checks and balances
Congress directs significant new spending and policy authority to executive agencies (NSF, Commerce, State, Treasury) through appropriations and program mandates, while retaining oversight through reporting requirements, sunset provisions on some programs, and Inspector General creation at USTR.
Historical precedent
The bill's semiconductor funding provisions were later enacted in modified form as the CHIPS and Science Act of 2022, representing the most direct legislative precedent.
