S-2370-119
Read twice and referred to the Committee on Armed Services.
Sponsored by Tammy Baldwin (D-WI)
What it does
This bill would make veterans who participated in Operation End Sweep eligible to receive the Vietnam Service Medal. The Secretary of the relevant military department would be authorized — but not required — to award the medal upon an individual veteran's application. Operation End Sweep was a 1973 U.S. military operation to clear mines from North Vietnamese waters following the Paris Peace Accords.
Who benefits
Veterans who served in Operation End Sweep (January–July 1973) and have not previously received the Vietnam Service Medal. This is a small, aging population of Navy and Marine Corps personnel who conducted minesweeping operations in North Vietnamese waters. Their surviving family members may also benefit from the recognition of their relative's service.
Who is hurt
No group faces a direct material harm from this bill. There is a minor administrative burden on the relevant military department secretaries to process applications. Taxpayers would bear any small administrative costs associated with producing and issuing medals, though this cost would be minimal.
Supporters argue
Supporters argue that Operation End Sweep veterans served in the Vietnam theater under hazardous conditions — clearing live naval mines from North Vietnamese waters — and that their exclusion from the Vietnam Service Medal is an oversight that leaves their service unrecognized relative to peers who served in the same conflict. They contend that correcting this gap honors a commitment to veterans and acknowledges the real dangers these service members faced during a combat-adjacent mission.
Opponents argue
Opponents might argue that the Vietnam Service Medal has defined eligibility criteria established by executive order, and that expanding eligibility through legislation rather than through the military's own awards review process sets a precedent for Congress to micromanage military honors. They could contend that the proper channel for correcting awards eligibility is the Department of Defense's internal review process, which is better positioned to evaluate service criteria consistently across all veterans.
Constitutional context
Congress has broad authority over military affairs under Article I, §8, including the power to raise and regulate the armed forces. Setting eligibility criteria for military decorations falls within this legislative authority. No active constitutional tension exists here — this is a straightforward exercise of Congress's military powers with no significant separation-of-powers dispute.
Checks and balances
Congress would expand medal eligibility by statute; the Secretary of the relevant military department retains discretionary authority over individual awards and application processing, preserving executive branch control over implementation.
Historical precedent
Congress has previously passed legislation expanding military medal eligibility for specific operations, such as authorizing the Korean Defense Service Medal (2002) for veterans of post-armistice service in Korea.
