Placed on Senate Legislative Calendar under General Orders. Calendar No. 486.
Sponsored by Alex Padilla (D-CA)
What it does
This bill would transfer administrative jurisdiction over approximately 160 acres of Stanislaus National Forest land to the National Park Service to be managed as part of Yosemite National Park, and simultaneously transfer approximately 170 acres of Yosemite National Park land to the U.S. Forest Service to be managed as part of Stanislaus National Forest. The two agencies would retain their respective cleanup responsibilities for any hazardous substances on the land they are transferring, and all existing rights-of-way, easements, leases, and permits would remain valid under the receiving agency.
Who benefits
Visitors to Yosemite National Park, who would gain access to Ackerson Meadow under National Park Service management and its associated visitor protections. Conservation and wildlife advocates who prefer National Park System protections for the meadow area. The National Park Service, which gains jurisdiction over land it may manage more consistently with park preservation goals. Hikers and recreationists who use Stanislaus National Forest and may benefit from adjusted boundaries that better reflect land use patterns.
Who is hurt
Existing permit and license holders on the transferred lands may face administrative changes as the receiving agency takes over management, even though existing authorizations are preserved. Timber, grazing, or other resource-use interests that operate under Forest Service rules on the 160 acres moving to NPS management could face more restrictive National Park System regulations. Local Tuolumne County stakeholders whose land-use expectations were tied to prior agency management may need to adapt to new management priorities.
Supporters argue
Supporters argue that Ackerson Meadow is ecologically contiguous with Yosemite National Park and that placing it under NPS management would provide stronger habitat protections for wildlife corridors and sensitive meadow ecosystems. They contend the land exchange is a straightforward administrative correction that aligns management authority with natural landscape boundaries, and that the simultaneous transfer of 170 acres to the Forest Service ensures neither agency loses overall acreage in a net-neutral swap.
Opponents argue
Opponents argue that transferring land from the Forest Service — which allows multiple uses including timber harvesting and grazing — to the more restrictive National Park System effectively removes that land from productive use without a full public lands review process. They contend that even a small acreage transfer can set a precedent for reclassifying federal lands in ways that reduce resource access, and that local communities and existing permit holders deserve more extensive consultation before management regimes change.
Constitutional context
Congress holds authority over federal lands under the Property Clause (Art. IV, §3, cl. 2), which grants broad power to dispose of and make rules for U.S. territory. No active constitutional tension is implicated here; this is a routine inter-agency administrative transfer fully within Congress's established property management authority.
Checks and balances
Congress directs the transfer; the Secretaries of Agriculture and Interior jointly implement it and may make minor boundary corrections by mutual agreement, with changes published in the Federal Register for public notice.
Historical precedent
Congress has routinely enacted similar inter-agency land jurisdiction transfers, including numerous boundary adjustments between National Forest and National Park units throughout the 20th and 21st centuries, such as adjustments to Grand Teton National Park boundaries in the 1950s.
