S-3219-119

What it does
This bill would transfer approximately 9.89 acres of federal land in Albuquerque, New Mexico — formerly part of the Albuquerque Indian School — into trust status for the benefit of 19 federally recognized Pueblo tribes. The General Services Administration would transfer administrative jurisdiction to the Secretary of the Interior within 90 days of enactment and relocation of federal tenants. The land would be held in trust for educational, health, cultural, business, and economic development purposes, with gaming of all classes explicitly prohibited.
Who benefits
The 19 named New Mexico Pueblos and their approximately 60,000–70,000 enrolled members, who would gain access to land with historical and cultural significance for community development. Tribal governments would gain a land asset usable for health clinics, schools, cultural centers, or economic enterprises. Albuquerque's urban Native American population, which is among the largest in the country, could benefit from expanded tribal services. Surrounding Bernalillo County communities could benefit indirectly from tribal economic development on the site.
Who is hurt
Federal agencies currently occupying the land as tenants would be required to relocate, incurring moving and transition costs. The General Services Administration would lose administrative jurisdiction over a potentially valuable urban parcel. Albuquerque and Bernalillo County would lose the property from their local tax base, as trust land is generally exempt from state and local property taxes. Private developers or other potential users of the urban parcel would lose access to a competitively available federal property.
Supporters argue
Supporters argue that the Albuquerque Indian School was established on land taken from Pueblo communities and that the school itself was used to forcibly assimilate Native children — making the return of this land a matter of historical restitution. They contend that trust status would give the 19 Pueblos a foothold in Albuquerque to deliver health, education, and cultural services to the city's large urban Native population, addressing documented disparities in access to tribal services for off-reservation members. The explicit gaming prohibition addresses a common objection to land-into-trust transfers.
Opponents argue
Opponents argue that removing urban federal land from the tax rolls imposes a fiscal burden on Albuquerque and Bernalillo County without compensation, shifting costs to local taxpayers and governments. They contend that land-into-trust transfers for multiple tribes over a single parcel create complex governance questions — including which tribal government has authority over decisions — that the bill does not resolve. Critics may also argue that the 90-day transfer timeline does not allow adequate time for environmental review or assessment of existing encumbrances that could complicate tribal use of the property.
Constitutional context
Congress holds broad authority over federal lands and tribal affairs under the Property Clause (Art. IV, §3) and the Indian Commerce Clause (Art. I, §8, cl. 3). Land-into-trust transfers for federally recognized tribes are a well-established exercise of federal power, and the Equal Protection concerns raised in Students for Fair Admissions v. Harvard (2023) generally do not apply to legislation targeting federally recognized tribes, as such classifications are treated as political rather than racial under Morton v. Mancari (1974).
Checks and balances
Congress directs the transfer; the Secretary of the Interior holds and administers the trust; the General Services Administration retains a limited easement on Tract 1; and existing encumbrances, easements, and utility agreements remain in force as checks on unrestricted tribal use.
Historical precedent
Congress has enacted numerous site-specific land-into-trust bills for federally recognized tribes, including the Puyallup Tribe Land Claims Settlement Act (1989) and various New Mexico Pueblo land restoration acts, establishing a clear legislative pattern for this type of transfer.
