Placed on Senate Legislative Calendar under General Orders. Calendar No. 507.
Sponsored by Jeff Merkley (D-OR)
What it does
This bill would direct the Secretary of State, in coordination with the Secretary of Defense, to establish a working group to assess Taiwan's drone production capacity and identify barriers to integrating Taiwanese manufacturers into the U.S. military's "Blue UAS" (secure, non-Chinese-sourced drone) program. It would also require the creation of a cooperative framework with regional allies to build drone supply chains independent of Chinese components, and a fast-track certification process for Taiwanese drone manufacturers seeking U.S. military approval. The working group would report to Congress annually for three years, and the bill explicitly preserves existing U.S. policy on Taiwan's international status and the One China Policy.
Who benefits
Taiwanese drone manufacturers and component suppliers who would gain streamlined access to U.S. military certification and contracts. U.S. defense contractors seeking non-Chinese drone supply chains. The U.S. military and Department of Defense, which would gain access to a broader pool of certified, secure drone components. Indo-Pacific regional allies seeking alternatives to Chinese-sourced drones. U.S. Army arsenals, depots, and ammunition plants that may gain new testing and sustainment roles. Academic and industry experts included in the working group. Indirectly, U.S. national security interests broadly, if supply chain diversification reduces cybersecurity vulnerabilities.
Who is hurt
Chinese drone manufacturers (particularly DJI and other PRC-based companies) that currently dominate the commercial and dual-use UAS market and would face reduced access to U.S. and allied procurement. U.S. or third-country drone companies that currently supply the military and may face new competition from fast-tracked Taiwanese suppliers. Taxpayers who may bear administrative costs of the working group and cooperative framework, though no specific dollar amount is authorized. Diplomatic relations with the People's Republic of China could be strained, with potential downstream effects on broader U.S.-China trade and security negotiations.
Supporters argue
Supporters argue that the vast majority of commercially available drones contain Chinese-sourced components, creating documented cybersecurity and supply chain vulnerabilities for U.S. and allied military operations. They contend that Taiwan is a natural partner — technologically capable, democratically aligned, and strategically positioned — and that building a PRC-independent drone supply chain directly advances the Taiwan Relations Act's mandate to support Taiwan's defensive capacity. They further argue that lessons from Ukraine's drone-intensive warfare demonstrate the urgent need to scale up secure, allied drone production before a potential Indo-Pacific conflict.
Opponents argue
Opponents argue that the bill risks provoking Beijing at a sensitive moment in U.S.-China relations, potentially accelerating military pressure on Taiwan rather than deterring it, and that deepening defense-industrial ties with Taiwan — even with the One China Policy carve-out — may be read by the PRC as a de facto shift in U.S. recognition policy. They also contend that fast-tracking certification for Taiwanese manufacturers could disadvantage domestic U.S. drone producers who face the same rigorous standards without expedited review, and that the bill's open-ended appropriations authorization lacks fiscal discipline or oversight mechanisms to ensure cost-effectiveness.
Constitutional context
The Foreign Commerce Clause (Art. I, §8, cl. 3) gives Congress broad authority to regulate trade with foreign nations, supporting the bill's supply chain and export control provisions. The bill also implicates the President's exclusive recognition power under Zivotofsky v. Kerry (2015), which is why the bill includes explicit rules of construction preserving the One China Policy and Taiwan's ambiguous international status — Congress cannot override the executive's recognition determinations.
Checks and balances
The executive branch (State and Defense Departments) gains new directive authority to build international frameworks and certification processes, but Congress retains oversight through mandatory annual reports to the appropriate congressional committees and controls future spending through the appropriations process.
Historical precedent
The Taiwan Relations Act of 1979 and the Taiwan Enhanced Resilience Act (2022) established the legislative framework for U.S. arms and defense support to Taiwan; this bill extends that tradition into the specific domain of drone supply chains and military certification.
