S-4407-119
Committee on Commerce, Science, and Transportation. Ordered to be reported with an amendment in the nature of a substitute favorably.
Sponsored by Ted Cruz (R-TX)
What it does
This bill would require companies that offer AI chatbots as their primary product to create "family accounts" giving parents control settings for children under 13, and to obtain verifiable parental consent before teens aged 13-17 can use such chatbots. It would also ban targeted advertising to minors based on their personal data, require disclosure labels showing users they are interacting with AI, and set enforcement through the FTC and state attorneys general.
Who benefits
Parents seeking oversight tools for their children's AI chatbot use, children and teens who may be protected from excessive engagement, data collection, or targeted advertising, and child-safety and privacy advocacy groups. Companies offering narrow-purpose AI tools (customer service, education, business tools) are exempt and unaffected.
Who is hurt
AI chatbot companies, particularly smaller developers, that must build new parental-control infrastructure, age-detection processes, and consent systems, incurring compliance costs. Teens who may lose independent access to chatbots if parents withhold consent, and companies that rely on targeted advertising revenue from minor users would lose that revenue stream. Some privacy advocates worry required "knowledge" of user age could pressure companies toward broader data collection despite the bill's stated protections against mandatory age verification.
Supporters argue
Supporters argue that AI chatbots increasingly substitute for human relationships among children and teens, and that parents currently lack basic tools to monitor or limit this use, unlike social media where parental controls are more common. They contend the bill's targeted-advertising ban and default-to-most-protective-settings approach address documented risks of manipulation, over-engagement, and inappropriate content, while explicitly avoiding mandatory government ID verification to protect privacy.
Opponents argue
Opponents argue that the "knows" standard for determining a user's age is vague and could expose companies to liability based on ambiguous "reasonable person" judgments, chilling innovation particularly among smaller developers. They contend the parental consent and default-settings requirements may restrict teens' access to legitimate educational or supportive uses of chatbots, and that compliance costs could concentrate the market among large incumbents able to afford the new infrastructure.
Constitutional context
The bill's requirements for consent, monitoring, and default settings for minors' speech-based interactions with AI implicate First Amendment concerns about minors' access to expressive content, an area the Supreme Court addressed in Packingham v. North Carolina (2017) regarding minors' and adults' access to online platforms, though this bill targets parental consent rather than outright bans. Its avoidance of mandatory age verification also reflects ongoing due process and vagueness concerns tied to the "knows" standard for determining user age.
Checks and balances
Congress assigns enforcement authority to the FTC as an unfair-or-deceptive-practices violation, with state attorneys general given concurrent parens patriae enforcement power subject to FTC notice and potential preemption during pending federal actions.
Historical precedent
The Children's Online Privacy Protection Act of 1998 established a similar framework of parental consent and data-use restrictions for children's online services, which this bill explicitly builds upon and cross-references.
