S-453-119
Read twice and referred to the Committee on Agriculture, Nutrition, and Forestry. (Sponsor introductory remarks on measure: CR S794-795)
Sponsored by Alex Padilla (D-CA)
What it does
This bill would establish a "Wildfire Intelligence Center" as a joint office shared among the Departments of Agriculture, Commerce, and Interior. The Center would consolidate wildfire data, modeling, forecasting, and decision-support tools currently scattered across multiple federal agencies, and make them available to federal, state, tribal, and local governments, land managers, and first responders. It would be governed by a 14-member board of career federal employees and led by an Executive Director with contracting authority.
Who benefits
State, tribal, and local governments that currently lack access to integrated federal wildfire data and tools. Firefighters and incident management teams who would receive real-time decision-support data. Communities in wildfire-prone areas (particularly in the Western U.S.) that would benefit from improved evacuation planning and risk assessments. Public health agencies tracking smoke and air quality impacts. Land managers and burned area rehabilitation teams. Private-sector contractors engaged in wildfire response. Researchers and academics who would gain access to consolidated data infrastructure. Residents in wildland-urban interface zones who may benefit from improved early warning and risk reduction tools.
Who is hurt
Federal agencies that currently control their own wildfire data and tools may lose some autonomy and budget flexibility. Private companies that currently provide proprietary wildfire data or modeling services could face increased competition from a free, federally consolidated platform. Taxpayers would bear the cost of establishing and operating the Center, though the bill does not specify an appropriations amount. Congressional appropriators may have reduced flexibility, as interagency fund transfers require only 15-day notice rather than new appropriations. States or localities that prefer existing bilateral relationships with individual agencies may find a centralized model less responsive to their specific needs.
Supporters argue
Supporters argue that wildfire data and science are currently fragmented across dozens of federal offices, creating dangerous gaps in real-time decision-making during active fires. They point to the 2023 Wildland Fire Mitigation and Management Commission report — produced by 50 diverse experts — which found that existing fire behavior models are not designed to meet rapidly changing ecosystem conditions and that interoperability failures reduce the effectiveness of federal response. They contend that consolidating predictive services, air quality monitoring, and risk mapping into a single interoperable center would directly improve outcomes for the millions of Americans living in wildland-urban interface zones, where wildfire risk has grown substantially in recent decades.
Opponents argue
Opponents argue that creating a new interagency office adds a layer of federal bureaucracy without guaranteeing improved outcomes, and that the bill's broad mandate — spanning pre-fire planning, active response, and post-fire recovery — risks duplicating functions already performed by the National Interagency Coordination Center and existing agency programs. They contend that the bill provides no specific authorization of appropriations, leaving funding levels undefined and potentially drawing resources away from existing operational programs. Critics may also argue that a 14-member board composed entirely of career federal employees, with no required representation from state, tribal, or local governments, may not adequately reflect the needs of the non-federal entities the Center is designed to serve.
Constitutional context
The bill rests on Congress's Commerce Clause authority (Art. I, §8, cl. 3) and the Necessary and Proper Clause (Art. I, §8, cl. 18) to organize and coordinate federal executive agencies. Because the Center is an interagency coordination body — not a new regulatory authority over private parties or land — it does not raise significant major questions doctrine concerns under West Virginia v. EPA (2022) or heightened post-Loper Bright scrutiny, as it does not purport to expand agency regulatory reach beyond existing statutory authority.
Checks and balances
The executive branch gains a new consolidated coordination office, but Congress retains oversight through required reporting, the 15-day advance notice requirement before interagency fund transfers, and the appropriations process, which controls the Center's ultimate funding level.
Historical precedent
The National Interagency Fire Center, established in 1965 as a joint operation between the Forest Service and Bureau of Land Management, represents a directly analogous prior effort to consolidate federal wildfire coordination across agencies.
