S-4598-119
Read twice and referred to the Committee on the Judiciary.
Sponsored by Kirsten Gillibrand (D-NY)
What it does
This bill would establish a 10-member United States Commission on Hate Crimes, composed of members from law enforcement and civil rights communities, appointed by congressional leaders and the Attorney General. The Commission would investigate factors driving hate crimes, underreporting problems, and prevention strategies, then submit a report with recommendations to Congress and the President within one year of full appointment. The bill would also direct the Government Accountability Office to audit the FBI's hate crime data collection methods and report findings to Congress within 18 months of enactment. The Commission would automatically terminate 90 days after submitting its report.
Who benefits
Communities frequently targeted by hate crimes — including racial and ethnic minorities, religious communities, LGBTQ+ individuals, and people with disabilities — who may benefit from improved data and prevention strategies. Law enforcement agencies that would receive clearer guidance on reporting and response. Civil rights nonprofit organizations, which are formally recognized as a source of expertise and data. Researchers and policymakers who would gain more reliable hate crime statistics. Victims of underreported hate crimes whose experiences may be better captured in future data.
Who is hurt
State and local law enforcement agencies that may face increased administrative burden from improved reporting requirements recommended by the Commission. Agencies currently classified as "zero-reporting" that may face scrutiny under the GAO audit. Federal agencies required to provide documents and data to the Commission upon request, bearing compliance costs. Taxpayers who would fund the Commission's operations and the GAO audit, though no specific appropriation amount is stated in the bill text.
Supporters argue
Supporters argue that the FBI's own acknowledgment of significant data gaps — including the unreliable 2021 statistics caused by the transition to the National Incident-Based Reporting System — demonstrates a clear need for independent review. They contend that with 11,323 single-bias incidents reported in 2024 alone, and documented surges such as a 344% increase in antisemitic incidents over five years, the federal government lacks the comprehensive, accurate data needed to design effective prevention policy. A study-and-recommend commission with built-in bipartisan balance and a mandatory sunset is a measured, low-cost first step toward evidence-based solutions.
Opponents argue
Opponents argue that Congress has enacted hate crime legislation repeatedly since 1968, and that creating another advisory commission risks producing a report that is shelved without producing binding policy change — a pattern critics call "study instead of action." They contend that existing bodies, including the FBI, the Bureau of Justice Statistics, and the Civil Rights Division of the DOJ, already have the authority and infrastructure to address data gaps without a new commission, and that the bill's lack of a specific appropriation raises questions about whether the Commission would be adequately resourced to conduct meaningful investigation.
Constitutional context
No significant constitutional tension is raised by this bill. Congress has broad authority under Article I and the Fourteenth Amendment, Section 5 to investigate and legislate against bias-motivated violence. The Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act (18 U.S.C. § 249), which defines "hate crime" for purposes of this bill, was upheld under Congress's Commerce Clause and Thirteenth Amendment authority. This bill creates only a study commission and a GAO audit — neither of which imposes criminal penalties or restricts individual rights.
Checks and balances
The Commission gains a temporary advisory role, with no rulemaking or enforcement power; its recommendations are non-binding, and Congress retains full authority to act or not act on the report. The GAO, as a legislative branch watchdog, independently audits the executive branch FBI, reinforcing existing oversight mechanisms.
Historical precedent
Congress established the National Commission on the Causes and Prevention of Violence in 1968 and has used similar advisory commissions to study crime and civil rights issues, though no commission specifically focused on hate crime data and prevention has previously been created at the federal level.
