S-5145-119
Read twice and referred to the Committee on Environment and Public Works.

What it does
This bill would clarify that existing Clean Air Act grants (Sections 103 and 105) can be used to purchase portable air sensors for wildfire smoke monitoring. It would also create a new competitive grant program ($10 million per year, FY2027–2032) and expand existing EPA air sensor loan programs to underserved regions, including tribal lands. The EPA would be required to provide technical assistance to grant recipients and to develop standardized quality assurance templates within 180 days of enactment.
Who benefits
Rural and remote communities — particularly in the western United States — that currently lack air quality monitoring infrastructure. Residents of tribal lands with limited monitoring coverage. People with respiratory or cardiac conditions who are especially vulnerable to wildfire smoke. State and local air pollution control agencies that would gain clearer authority and additional funding to deploy sensors. Public health researchers and emergency managers who rely on real-time air quality data. Developers and operators of public air quality mapping tools such as EPA's AirNow Fire and Smoke Map.
Who is hurt
Manufacturers or vendors of traditional regulatory-grade air monitors, who could face reduced demand if agencies shift spending toward lower-cost sensors. Taxpayers who would bear the cost of up to $60 million in authorized appropriations over six years, plus additional "such sums as necessary" for loan programs and technical assistance. Agencies or communities not prioritized under the bill's criteria (urban areas, regions with existing monitoring) that may receive fewer resources relative to rural-focused recipients.
Supporters argue
Supporters argue that wildfire smoke is a growing public health threat — particularly in rural western communities — where the absence of air quality monitoring leaves residents without the data needed to protect themselves. They contend the bill addresses a documented gap: standard regulatory air monitors are expensive and sparse in remote areas, while lower-cost portable sensors can provide near-real-time data at a fraction of the cost. By clarifying existing grant authority and adding targeted funding, the bill would extend life-saving air quality information to populations currently left without it.
Opponents argue
Opponents argue that portable air sensors, while cheaper, produce data of lower accuracy and reliability than regulatory-grade monitors, and that deploying them at scale without adequate quality controls could mislead the public or produce inconsistent health guidance. They contend the bill's authorization of "such sums as necessary" for loan programs and technical assistance creates open-ended spending commitments without sufficient congressional oversight, and that the $10 million annual grant program duplicates existing EPA authorities rather than filling a genuine statutory gap.
Constitutional context
The bill operates under Congress's Commerce Clause authority (Art. I, §8, cl. 3), which is the established basis for the Clean Air Act. No significant constitutional tension is present: the bill clarifies and modestly expands an existing grant framework rather than asserting new regulatory authority over private conduct. Post-Loper Bright (2024), courts would independently review any EPA rulemaking implementing this program, but the bill's narrow, grant-based mechanism is unlikely to raise major questions doctrine concerns under West Virginia v. EPA (2022).
Checks and balances
Congress sets the grant program structure and funding caps; the EPA Administrator retains discretion over competitive grant awards and program expansion; appropriations committees control actual funding, since authorizations do not guarantee spending.
Historical precedent
The Clean Air Act Sections 103 and 105 grant programs have funded state and local air monitoring infrastructure since 1970; this bill clarifies and supplements those existing programs rather than creating an entirely new framework.
