S-5146-119
Read twice and referred to the Committee on Health, Education, Labor, and Pensions.
Sponsored by Patty Murray (D-WA)
What it does
This bill would amend the Higher Education Act of 1965 to extend a range of supports to homeless youth and foster care youth at colleges and universities. It would require institutions receiving federal aid to designate a trained staff liaison, give these students priority access to campus housing, and provide in-state tuition rates at public colleges regardless of residency. It would also expand eligibility and outreach requirements for existing federal college-access programs (TRIO, Talent Search, Upward Bound, Student Support Services, Educational Opportunity Centers, and GEAR UP), direct the Student Loan Ombudsman to resolve financial aid independence disputes for these students, and require the Department of Education to issue guidance, conduct annual training, and report to Congress on effective strategies.
Who benefits
Homeless youth and foster care youth seeking to enroll in or complete college — estimated at hundreds of thousands of students annually. Former foster youth who aged out of the system at 13 or older, including those later adopted or placed in guardianship. Unaccompanied youth at risk of homelessness. Community-based organizations and child welfare agencies that would gain formal partnership pathways with colleges. College staff hired or designated as liaisons. Institutions that would receive clearer federal guidance on serving these populations.
Who is hurt
Public colleges and universities that would bear administrative costs of designating and training liaisons, updating websites, revising admissions applications, and developing housing plans — without explicit new federal funding for those compliance costs. Institutions in high-cost housing markets where providing priority or bridge housing access could strain limited inventory, potentially displacing other low-income students competing for the same beds. State governments that may lose tuition revenue if in-state rate mandates apply to students who would otherwise pay out-of-state rates. Existing TRIO and GEAR UP program participants who may face increased competition for limited program slots as outreach expands.
Supporters argue
Supporters argue that homeless and foster youth face severe structural barriers to college completion — research consistently shows foster youth graduate college at rates below 10%, compared to roughly 60% for the general population, and that lack of stable housing and financial aid complexity are primary drivers. They contend the bill addresses concrete, documented gaps: many institutions have no designated point of contact for these students, financial aid independence determinations are frequently delayed or denied, and campus housing closes during breaks when these students have nowhere else to go. Supporters argue that expanding TRIO and GEAR UP outreach to these populations leverages existing federal infrastructure at marginal additional cost.
Opponents argue
Opponents argue that the bill imposes significant unfunded mandates on colleges and universities — requiring dedicated staff, housing priority systems, revised admissions processes, and multi-year reporting — without authorizing new appropriations to cover those costs, effectively shifting the financial burden to institutions and their broader student populations. They contend that in-state tuition mandates tied to federal funding receipt under the Spending Clause may pressure states to forgo institutional autonomy over tuition policy, and that the bill's broad definitions of eligible youth (including those "at risk of homelessness") could create administrative ambiguity and invite disputes over who qualifies, straining financial aid offices already managing complex caseloads.
Constitutional context
The bill operates under the Spending Clause (Art. I, §8, cl. 1), conditioning federal higher education funding on institutional compliance with new liaison, housing, and tuition requirements. Under South Dakota v. Dole (1987), such conditions are permissible if they are unambiguous, related to the federal interest, and do not cross the line from incentive to coercion — the in-state tuition mandate and housing priority requirements tied to all federal aid receipt could invite a coercion challenge, though no court has yet found a higher education spending condition coercive.
Checks and balances
The Executive Branch (Department of Education) gains authority to issue guidance, conduct training, and collect compliance data from institutions; Congress retains oversight through required periodic reports, and institutions retain the ability to challenge conditions through administrative and judicial processes.
Historical precedent
The Foster Care Independence Act of 1999 and subsequent Fostering Connections to Success Act (2008) extended federal support for foster youth transitioning to adulthood, and many states have enacted their own foster youth tuition waiver laws, providing a partial legislative analogue to this bill's in-state tuition and support provisions.
