S-5234-119
Read twice and referred to the Committee on Environment and Public Works.
Sponsored by Adam Schiff (D-CA)
What it does
This bill would amend a 1931 law to create a "Human-Wildlife Conflict Reduction Program" within the Department of Agriculture that develops and funds nonlethal strategies to reduce conflicts between humans, livestock, and wildlife, including predator depredation of livestock. It would fold the existing Nonlethal Initiative of the Animal and Plant Health Inspection Service into the new program and authorizes $20 million per year from 2027 through 2031 for research, assistance to landowners and tribes, training, and state-level planning.
Who benefits
Livestock producers and agricultural landowners who receive assistance and training in nonlethal deterrence methods; Indian Tribes and nonprofit organizations eligible for program assistance; wildlife conservation groups and researchers who favor nonlethal management over lethal predator control; states already running Nonlethal Initiative programs, which get priority; wildlife species subject to reduced lethal control.
Who is hurt
Entities or contractors focused on lethal predator control methods, who may see reduced federal support or funding competition; taxpayers who fund the $20 million annual appropriation; ranchers in states without existing Nonlethal Initiative programs, who may receive lower funding priority; producers who believe nonlethal methods are less effective for their specific circumstances and preferred continued emphasis on lethal control.
Supporters argue
Supporters argue that nonlethal deterrence methods, such as guard animals, fencing, and deterrent devices, can reduce livestock losses while avoiding the ecological disruption and public controversy associated with lethal predator control programs. They contend that consolidating and expanding the existing Nonlethal Initiative into a formal program with dedicated research funding, best-practices sharing, and state-level planning would improve outcomes for ranchers and reduce conflict with protected or sensitive predator species more sustainably than the status quo.
Opponents argue
Opponents argue that nonlethal methods are not always effective against determined or habituated predators and that prioritizing them may leave ranchers with fewer tools when depredation losses continue, potentially harming livelihoods in livestock-dependent communities. They contend that a new $100 million five-year program duplicates existing wildlife management authority already handled through Wildlife Services and other federal channels, and that funding may be better directed toward proven lethal control methods where nonlethal approaches have failed.
Constitutional context
This bill exercises Congress's spending power under Article I, Section 8 to fund an agricultural and wildlife management program administered through an existing federal agency, and does not raise the major-questions or Commerce Clause concerns that arise with sweeping regulatory mandates since it creates a voluntary assistance and research program rather than binding regulation.
Checks and balances
Congress directs the Secretary of Agriculture to establish and administer the program, with an annual reporting requirement to Congress serving as an oversight mechanism, and appropriations are capped and time-limited through fiscal year 2031.
Historical precedent
The bill builds directly on the existing Nonlethal Initiative operated by the Animal and Plant Health Inspection Service, which it formally subsumes into the new statutory program.
