What it does
This bill would amend the Fair Labor Standards Act (FLSA) to extend overtime pay requirements to agricultural workers, phasing in a 40-hour overtime threshold between 2027 and 2030 for larger employers (more than 25 employees) and between 2030 and 2033 for smaller employers (25 or fewer). It would also repeal several existing FLSA exemptions that currently exclude many farm workers from minimum wage, child labor, and other labor protections. Family members employed by a farm operator would remain exempt.
Who benefits
Agricultural workers — estimated at roughly 2.4 million hired farm workers in the U.S. — who would gain overtime pay eligibility and other labor protections for the first time. Migrant and seasonal workers, who are disproportionately affected by current exemptions, would see the largest gains. Labor unions and worker advocacy organizations representing farm workers would gain stronger legal footing. Workers in other industries who currently compete with lower-cost agricultural labor may benefit indirectly from a more level playing field.

Opponents argue
Opponents argue that agriculture is fundamentally different from other industries — harvests are time-sensitive, weather-dependent, and cannot be rescheduled, meaning overtime costs cannot simply be avoided by spreading work across more shifts. They contend that mandatory overtime premiums would accelerate the adoption of automation and reduce total hours available to farm workers, potentially leaving the workers the bill aims to help with lower annual incomes. Opponents also point to studies of California's phase-in showing mixed results, with some farms reducing worker hours and others shifting to piece-rate pay structures that may not improve total compensation.
Constitutional context
Congress's authority to regulate agricultural labor falls squarely within the Commerce Clause (Art. I, §8, cl. 3), as affirmed by Wickard v. Filburn (1942), which held that even local agricultural activity substantially affects interstate commerce in the aggregate. This bill amends an existing statute (the FLSA) with explicit congressional authorization, so it is unlikely to raise major questions doctrine concerns under West Virginia v.
