What it does
This bill would let the Under Secretary of Commerce for Industry and Security hire up to 25 outside experts to the Bureau of Industry and Security without following normal civil service hiring rules, for terms up to 5 years. It would allow pay up to senior-level federal rates plus locality adjustments, capped at the Vice President's total compensation, and requires annual reporting to Congress on staffing gaps and hires. The hiring authority would expire after 5 years, though employees hired under it could finish their terms.
Who benefits
The Bureau of Industry and Security, which enforces export controls on sensitive technology; national security agencies relying on BIS expertise in areas like semiconductors and advanced technology; up to 25 specialized hires per year who could receive higher pay than standard civil service rates; and industries dependent on effective, timely export licensing decisions.
Who is hurt
Civil service applicants and career federal employees at BIS who compete for the same specialized roles but must go through standard hiring processes; federal employee unions that may view the exemption as eroding competitive-service protections; and taxpayers who would bear the cost of higher salaries for these positions, though the number affected is small.
Supporters argue
Supporters argue that BIS struggles to compete with private-sector salaries for specialists in semiconductors, artificial intelligence, and other advanced technologies critical to export control enforcement, and that normal civil service hiring and pay rules are too slow and rigid to attract this narrow pool of talent. They contend that similar direct-hire and enhanced-pay authorities have helped other agencies fill critical technical gaps, and that the 25-person cap, 5-year term limits, and pay ceiling tied to the Vice President's salary build in safeguards against abuse.
Opponents argue
Opponents argue that bypassing standard civil service hiring and classification rules, even for a small number of positions, risks favoritism or reduced accountability in a sensitive national security function, and that pay above normal federal scales could create morale problems among career staff performing similar work. They contend that if BIS truly needs specialized expertise, Congress should first assess whether existing direct-hire and special pay authorities available government-wide are being fully used before creating another agency-specific exemption.
Constitutional context
Congress has broad authority under the Necessary and Proper Clause to structure federal agencies and set the terms of employment for executive branch personnel, and this bill is a straightforward exercise of that power rather than a case implicating separation-of-powers doctrines like removal authority or the Appointments Clause, since these hires would remain subordinate employees rather than Senate-confirmed or principal officers.
Checks and balances
Congress grants the executive branch (the Under Secretary of Commerce) new personnel and pay flexibility, while retaining oversight through mandatory annual reporting to four congressional committees and statutory limits on hire numbers, pay, and term length.
Historical precedent
Congress has previously granted similar direct-hire and enhanced-pay authorities to other agencies facing specialized technical recruitment challenges, such as cybersecurity direct-hire authority at DHS and the intelligence community's excepted-service pay flexibilities.
