S-91-119
Placed on Senate Legislative Calendar under General Orders. Calendar No. 629.
Sponsored by Catherine Cortez Masto (D-NV)
What it does
This bill would modify federal wildfire management across three areas: preparation (improving firefighting spending transparency, requiring DOD reimbursement for state fire suppression costs from military training fires, and mandating fireshed-level planning), detection and suppression (expanding sensors, drones, and slip-on tanker units, including new eligibility for Indian Tribes), and post-fire recovery (creating permanent Burned Area Emergency Response Teams, a new $100 million annual rehabilitation account, and a prize competition for invasive species management technology). It also directs several federal studies and reports on firefighter training gaps, drone incursions, and modernizing wildfire response technology.
Who benefits
Communities and property owners in wildfire-prone Western states, state and local fire agencies (including Indian Tribes now eligible for tanker unit funding), federal land management agencies gaining new tools and funding, technology companies developing wildfire detection and drone equipment, and researchers and universities receiving R&D funding through the Joint Fire Science Program.
Who is hurt
Federal taxpayers who would fund the new $100 million annual rehabilitation account and various authorized appropriations, the Department of Defense which must budget for reimbursing states for training-caused fires, and federal agencies (Interior, Agriculture, FAA, DHS) that face new administrative burdens from reporting, study, and planning requirements. Drone hobbyists and commercial drone operators could face new restrictions if the drone incursion study leads to future enforcement actions like seizure or disabling of drones.
Supporters argue
Supporters argue that catastrophic wildfires have grown larger and more destructive across the West, and that this bill addresses documented gaps by improving detection technology, standardizing post-fire rehabilitation funding, and clarifying that the military reimburses states for fires its training exercises cause. They contend the permanent Burned Area Emergency Response Teams and dedicated rehabilitation account would provide more consistent, predictable recovery funding than the current ad hoc approach, citing the recurring cycle of fire followed by flooding and erosion that damages watersheds for years afterward.
Opponents argue
Opponents argue that the bill authorizes new spending, including up to $100 million annually for rehabilitation and open-ended sums for research, without offsetting cuts, adding to federal deficits during a period of fiscal constraint. They contend that layering additional studies, reports, and advisory boards onto already-strained land management agencies may slow implementation rather than speed it, and that provisions allowing reasonable force to disable or seize private drones raise due process and property concerns that need more scrutiny before enactment.
Constitutional context
Congress's authority to fund and direct federal land management agencies and the military derives from its Article I spending power and its authority over federal property under the Property Clause (Art. IV, §3); this bill raises no unresolved constitutional question, as it operates through appropriations, agency directives, and reporting requirements rather than sweeping new regulatory authority.
Checks and balances
Congress directs and funds executive agencies (Interior, Agriculture, Defense, DHS, FAA) through specific statutory mandates and reporting requirements, preserving oversight through committee reports and sunset provisions on several new programs.
Historical precedent
This bill builds on existing wildfire authorities such as the Infrastructure Investment and Jobs Act's slip-on tanker pilot program and the Healthy Forests Restoration Act's resource management planning framework, expanding and formalizing programs already established in prior legislation.
