SJRES-70-119
Read twice and referred to the Committee on Foreign Relations.
Sponsored by Bernard Sanders (I-VT)
What it does
This joint resolution would prohibit a specific proposed arms export to Israel: 5,000 M5 Commando 5.56mm fully automatic rifles, valued at $1,000,000 or more, destined for the Israel National Police through the private company M.R.D. Efram Investments Ltd. It exercises Congress's authority under the Arms Export Control Act (AECA), which requires the executive branch to notify Congress of proposed arms sales above certain thresholds and allows Congress to pass a joint resolution of disapproval to block them. If enacted, the export license described in Transmittal No. DDTC 23-066 would be prohibited.
Who benefits
Members of Congress who argue the legislative branch should have a stronger check on arms exports. Human rights organizations and advocates who have raised concerns about U.S. weapons transfers to Israel. Palestinian civilians and others who argue fewer weapons in the region reduces potential for harm. U.S. allies and international bodies that have called for restrictions on arms transfers to conflict zones. Domestic firearms manufacturers who compete with exports (marginally, as this is a small sale).
Who is hurt
The Israeli National Police, which would not receive the requested rifles. M.R.D. Efram Investments Ltd., the Israeli private company facilitating the sale, which would lose the contract. The U.S. defense manufacturer producing the M5 Commando rifles, which would lose the export sale. The executive branch (State Department/DDTC), which would have its approved export notification overridden. U.S.-Israel diplomatic relations could be strained if the resolution were enacted. U.S. arms exporters more broadly, if the precedent of congressional disapproval resolutions becomes more common.
Supporters argue
Supporters argue that Congress has both the legal authority and the constitutional responsibility to scrutinize arms exports, particularly to countries involved in active conflicts. They contend that automatic rifles sent to the Israel National Police — a domestic law enforcement body — could be used in the occupied West Bank, where human rights organizations have documented civilian casualties and excessive force. They argue that the AECA's disapproval mechanism exists precisely for situations where Congress believes an export is inconsistent with U.S. foreign policy values, and that exercising it here is a legitimate check on executive discretion.
Opponents argue
Opponents argue that blocking this sale would undermine a longstanding U.S.-Israel security partnership and set a damaging precedent of congressional micromanagement of routine arms transfers. They contend that the Israel National Police is a legitimate law enforcement agency, that the rifles are standard equipment for such a force, and that the executive branch — which has broader intelligence and diplomatic context — is better positioned to evaluate the appropriateness of specific sales. They further argue that disapproving a $1 million sale of rifles sends a disproportionate diplomatic signal that could weaken U.S. credibility with other security partners.
Constitutional context
The Foreign Commerce Clause (Art. I, §8, cl. 3) and the Declare War Clause (Art. I, §8, cl. 11) give Congress authority over foreign trade and military matters, while the Commander-in-Chief Clause (Art. II, §2, cl. 1) and the President's broad foreign affairs powers give the executive branch primary control over arms export policy. This resolution operates within the statutory framework Congress itself created — the Arms Export Control Act — which explicitly provides a disapproval mechanism, making this a congressionally authorized check rather than a novel separation-of-powers conflict.
Checks and balances
Congress would gain the ability to block this specific executive-approved export; the check on Congress is that the resolution must pass both chambers and survive a potential presidential veto, requiring a two-thirds override majority if vetoed.
Historical precedent
Congress has introduced numerous arms export disapproval resolutions under the AECA since the 1970s, but very few have passed both chambers; a 1986 resolution disapproving a Saudi arms sale passed the Senate but was vetoed by President Reagan.
