SRES-166-118
Resolution agreed to in Senate without amendment and an amended preamble by Unanimous Consent.
Sponsored by Ted Cruz (R-TX)
What it does
This resolution expresses the Senate's gratitude to the U.S. Coast Guard for its maritime border security operations. It recites specific fiscal year 2022 statistics — including drug interdictions, fishing vessel boardings, and migrant interdictions — and formally congratulates the Coast Guard on its service. As a simple Senate resolution, it does not create law, appropriate funds, or change any policy.
Who benefits
Active-duty Coast Guard members and veterans who receive formal congressional recognition of their service. Coast Guard leadership, whose operational record is publicly affirmed by the Senate. Indirectly, communities and industries that rely on maritime safety and security, whose dependence on the Coast Guard is highlighted.
Who is hurt
No group is directly harmed by a commemorative resolution. Critics of current maritime enforcement policy may object to the implicit endorsement of specific enforcement statistics, but the resolution creates no legal obligations or penalties for any party.
Supporters argue
Supporters argue that the Coast Guard's fiscal year 2022 record — interdicting over 330,000 pounds of cocaine, conducting roughly 12,500 migrant interdictions (a 350% increase from 2021), and patrolling over 95,000 miles of coastline — represents exceptional performance that merits formal congressional recognition. They contend that publicly honoring the service reinforces institutional morale and acknowledges the sacrifices of over 50,000 Coast Guard members who operate in dangerous maritime environments.
Opponents argue
Opponents argue that framing a commemorative resolution around specific enforcement statistics — particularly a 350% increase in migrant interdictions — functions as an implicit policy endorsement rather than a neutral tribute, potentially prejudging complex humanitarian and legal questions surrounding maritime migration. They contend that selectively highlighting these metrics, without acknowledging the Coast Guard's search-and-rescue or environmental protection missions, presents a one-sided picture of the service's broad mandate.
Constitutional context
No significant constitutional issues are raised by a commemorative Senate resolution. The resolution does not exercise legislative power, appropriate funds, or regulate conduct, so no enumerated powers or rights provisions are implicated.
Checks and balances
No branch gains or loses power under this resolution; it is a non-binding expression of Senate sentiment with no legal effect on any branch of government.
Historical precedent
Congress regularly passes commemorative resolutions honoring military branches and federal agencies; these are a routine form of non-binding congressional expression with no direct policy effect.
