SRES-186-119
Submitted in the Senate, considered, and agreed to without amendment and with a preamble by Unanimous Consent. (consideration: CR S2643; text: CR S2669)
Sponsored by Chuck Grassley (R-IA)
What it does
This Senate resolution designates April 29, 2025, as "National Fentanyl Awareness Day." It expresses the Senate's support for increasing public awareness of counterfeit fentanyl pills and their impact on families and young people. It also applauds federal, state, and local law enforcement efforts and encourages use of existing legal authorities to combat the spread of illicit counterfeit pills. The resolution does not create new law, appropriate funds, or establish any enforcement mechanism.
Who benefits
Families and communities affected by fentanyl overdose deaths, who may benefit from increased public awareness. Young people and teenagers, who are disproportionately affected by counterfeit pill exposure. Public health organizations and advocacy groups focused on opioid awareness, who gain a formal congressional endorsement of their messaging. Law enforcement agencies, whose anti-fentanyl work receives formal Senate recognition. Drug prevention educators and school counselors who use awareness campaigns in their work.
Who is hurt
No group is directly harmed by this resolution, as it carries no legal force, spending, or regulatory effect. Indirectly, critics of symbolic legislation may argue that congressional time and attention spent on non-binding resolutions could be directed toward legislation with enforceable impact. There are no identifiable groups who bear a material cost from this resolution's passage.
Supporters argue
Supporters argue that awareness is a measurable gap in the fentanyl crisis: in 2024, only 55% of youth and 50% of teens considered themselves knowledgeable about fentanyl, and only 65% of youth knew it was being used in counterfeit pills. They contend that public awareness campaigns have documented effectiveness in reducing drug use among adolescents, and that a formal Senate designation amplifies the reach of those campaigns at no cost to taxpayers.
Opponents argue
Opponents argue that a non-binding awareness resolution does nothing to address the structural drivers of the fentanyl crisis — such as supply chain interdiction, treatment access, or social media platform accountability — while more than 84,000 Americans died of drug-induced deaths in the 12-month period ending October 2024. They contend that symbolic resolutions can create the appearance of legislative action without producing measurable reductions in overdose deaths or counterfeit pill availability.
Constitutional context
No significant constitutional issues are raised by this resolution. Senate resolutions expressing the sense of the chamber and designating awareness days are a well-established congressional practice that does not implicate enumerated powers, agency authority, or individual rights.
Checks and balances
This resolution is internal to the Senate and does not shift power between branches; it creates no new executive authority, no agency rulemaking obligation, and no judicial review pathway.
Historical precedent
Congress has passed similar non-binding resolutions designating awareness days for opioid-related issues in prior sessions, including resolutions recognizing National Drug Take Back Day and National Prescription Drug Abuse and Heroin Awareness Week.
