SRES-763-119
Referred to the Committee on Foreign Relations. (text: CR S2702)
Sponsored by Lisa Murkowski (R-AK)
What it does
This resolution would express the Senate's formal position that the Arctic region is strategically important to U.S. national security and economic interests. It would affirm support for continued cooperation with Arctic allies through NATO and multilateral forums, endorse engagement with Indigenous peoples in Arctic governance, and encourage congressional delegations and intergovernmental exchanges with Arctic partner nations. As a simple resolution, it would not create law, appropriate funds, or impose any binding obligations.
Who benefits
U.S. defense and intelligence agencies that gain a congressional signal supporting Arctic security investment. NATO Arctic allies (Canada, Denmark, Finland, Iceland, Norway, Sweden) whose partnership with the U.S. is formally reaffirmed. Arctic Indigenous communities whose role in governance is explicitly recognized. U.S. companies in shipping, energy, telecommunications, and infrastructure that may benefit from a policy environment favorable to Arctic development. Scientific research institutions with Arctic programs.
Who is hurt
No group is directly harmed by a non-binding resolution. Indirectly, Russia and China — whose strategic competition in the Arctic is cited as a concern — may view the resolution as a diplomatic signal against their regional interests. Advocates for diplomatic engagement with Russia or China on Arctic issues may argue the resolution's framing narrows the space for cooperative approaches with those nations.
Supporters argue
Supporters argue that the Arctic is rapidly becoming a major theater of great-power competition, with Russia operating over 40 icebreakers and China declaring itself a "near-Arctic state" while expanding its polar presence. They contend that a formal Senate statement reinforces the credibility of U.S. commitments to NATO Arctic allies — particularly newly acceded members Sweden and Finland — and signals bipartisan resolve at a moment when allied confidence in U.S. engagement is strategically important.
Opponents argue
Opponents argue that a non-binding resolution carries no enforcement mechanism and risks creating the appearance of action without substance, potentially substituting symbolic politics for the concrete funding, icebreaker procurement, and infrastructure investment the Arctic actually requires. They contend that the resolution's broad language — endorsing everything from telecommunications resilience to Indigenous governance — lacks the specificity needed to meaningfully guide policy, and that congressional resources would be better directed toward authorizing legislation or appropriations with real effect.
Constitutional context
The Constitution divides foreign policy authority between the branches: Congress holds the Foreign Commerce Clause (Art. I, §8, cl. 3) and the power to declare war (Art. I, §8, cl. 11), while the President holds the Commander-in-Chief power (Art. II, §2, cl. 1) and the exclusive recognition power affirmed in Zivotofsky v. Kerry (2015). This resolution does not encroach on executive foreign policy authority — it expresses a congressional viewpoint and encourages engagement, which falls within Congress's advisory and oversight role rather than any binding constitutional function.
Checks and balances
Congress expresses a non-binding policy position; no branch gains or loses formal authority, and the executive retains full discretion over how — or whether — to act on the resolution's stated priorities.
Historical precedent
Congress has regularly passed non-binding resolutions affirming Arctic policy priorities, including S. Res. 271 (114th Congress), which similarly expressed support for U.S. Arctic engagement and the Arctic Council framework.
