SRES-776-119
Submitted in the Senate, considered, and agreed to without amendment and with a preamble by Unanimous Consent. (consideration: CR S2886; text: CR S2899)
Sponsored by Ted Budd (R-NC)
What it does
This resolution honors the life and career of Kyle Thomas Busch, a professional NASCAR driver who passed away on May 21, 2026, at age 41. It recounts his racing achievements, personal milestones, and family. The Senate directs the Secretary of the Senate to communicate the resolution to the House of Representatives.
Who benefits
Kyle Busch's family — his wife Samantha, children Brexton and Lennix, parents, and brother Kurt Busch — receives formal congressional recognition of his life. NASCAR fans, the motorsports community, and residents of Las Vegas, Nevada, and Charlotte, North Carolina, may find symbolic value in the tribute. Kyle Busch Motorsports employees and Joe Gibbs Racing and Richard Childress Racing communities are also recognized indirectly.
Who is hurt
This resolution has no regulatory, fiscal, or legal effect on any person or group. No party is negatively affected.
Supporters argue
Supporters argue that Congress has a long tradition of formally honoring distinguished Americans who have made lasting contributions to their fields, and that Kyle Busch's record of 234 NASCAR victories across all three national series — the most in the sport's history — represents an extraordinary athletic and cultural legacy. They contend that a bipartisan resolution, co-sponsored by senators from both parties representing Nevada and North Carolina, appropriately reflects the national reach of Busch's impact on American motorsports.
Opponents argue
Opponents might argue that honorary resolutions for individual private citizens, however accomplished, represent a use of limited Senate floor time that could be directed toward pressing legislative business. They could contend that singling out one athlete for formal congressional recognition, while countless other distinguished Americans go unrecognized, raises questions about the criteria and consistency of such tributes.
Constitutional context
No constitutional issues are raised by this resolution. Commemorative resolutions are a well-established congressional practice with no meaningful nexus to enumerated powers, agency authority, or individual rights provisions.
Checks and balances
Congress exercises its non-legislative ceremonial function; no branch gains or loses power, and no executive or judicial action is triggered.
Historical precedent
Congress regularly passes commemorative resolutions honoring deceased public figures and athletes; such resolutions are a routine, non-binding form of congressional expression with no legislative effect.
