SRES-841-119
Referred to the Committee on Foreign Relations.
Sponsored by Jeanne Shaheen (D-NH)
What it does
This resolution would express the sense of the Senate on the 35th anniversary of Ukrainian independence from the Soviet Union. It would formally recognize Ukraine's sovereignty and territorial integrity within its 1991 borders, condemn Russia's 2022 invasion, affirm the 2018 Crimea Declaration, and encourage U.S. diplomatic efforts toward a peace agreement. It would also encourage Ukraine to continue anti-corruption efforts and encourage the U.S. military to study lessons from Ukraine's drone warfare innovations. As a simple Senate resolution, it would carry no binding legal force and would not appropriate funds.
Who benefits
The Ukrainian government and Ukrainian diaspora communities in the United States, who gain a formal symbolic expression of U.S. Senate support. U.S. defense contractors and military planners interested in drone and counter-drone technology, who are encouraged by the resolution to integrate Ukrainian battlefield lessons. NATO allies, who benefit from reaffirmed U.S. commitment to the trans-Atlantic security architecture. Advocates for U.S. engagement in the Russia-Ukraine conflict, who gain a public congressional statement supporting continued diplomacy.
Who is hurt
The resolution carries no binding legal or fiscal effect, so no group faces direct material harm. Indirectly, those who favor reduced U.S. involvement in the Russia-Ukraine conflict may view the resolution's encouragement of a "strong security guarantee" for Ukraine as political pressure toward deeper engagement. The Russian government is explicitly condemned in the resolution's text. Advocates for a negotiated settlement that does not restore Ukraine's 1991 borders may find the resolution's territorial integrity language at odds with their preferred diplomatic framework.
Supporters argue
Supporters argue that marking the 35th anniversary of Ukrainian independence with a formal Senate statement reinforces a bipartisan U.S. commitment to sovereignty and the rules-based international order at a critical moment in the ongoing conflict. They contend that the resolution's broad, bipartisan sponsorship — spanning both parties and multiple ideological factions — demonstrates that support for Ukraine's independence is a durable American value, not a partisan position. They further argue that encouraging the Pentagon to study Ukraine's drone warfare innovations serves a direct U.S. national security interest, independent of any position on the conflict itself.
Opponents argue
Opponents argue that even non-binding resolutions carry diplomatic weight and that language calling for a "strong security guarantee" for Ukraine could constrain U.S. negotiating flexibility or signal commitments the executive branch has not formally made, complicating ongoing peace diplomacy. They contend that the resolution's characterization of the invasion as "unprovoked" and its insistence on full restoration of 1991 borders reflects one diplomatic framework over others, potentially hardening positions at a moment when pragmatic compromise may be necessary to end the conflict. They also argue that Congress should focus on binding legislation rather than symbolic statements on complex, evolving foreign policy situations.
Constitutional context
Simple Senate resolutions express the sense of one chamber and carry no binding legal force, so they do not raise significant constitutional concerns. The Resolution Clause and the President's exclusive recognition power under the Reception Clause (Art. II, §3), as affirmed in Zivotofsky v. Kerry (2015), are relevant context: while the Senate may express its views on foreign policy, it cannot compel the executive branch to adopt a particular recognition posture or diplomatic stance through a non-binding resolution.
Checks and balances
The Senate expresses a collective foreign policy view, but the executive branch retains exclusive authority over diplomatic recognition, treaty negotiation, and military deployment; this resolution creates no enforceable obligation on the President or any agency.
Historical precedent
The Senate has passed numerous commemorative and sense-of-the-Senate resolutions on foreign conflicts and anniversaries, including resolutions marking prior Ukrainian independence anniversaries and condemning Russia's 2014 annexation of Crimea (S. Res. 370, 113th Congress).
